Summary:  The Negotiated Settlement: An Innovative Tool to Support Companies in Crisis.

As of 1 November 2021, the institution of negotiated crisis resolution entered into force in the Italian legal system. The new instrument is aimed at entrepreneurs who find themselves in economic difficulties and aims to rehabilitate the enterprise if there are reasonable prospects for continuing the business.

The appointed expert facilitates negotiations with creditors to find a suitable solution to overcome the economic difficulties of the enterprise. Based on their economic and legal know-how, they can assess whether a reorganization is possible and reasonable. Simultaneously, using various mediation and communication techniques, they can inform creditors about the proceedings and establish goal-oriented cooperation.

In this webinar, the speakers will explain which legal instruments are available for dealing with business crises, how they work, and what advantages are associated with their use. Additionally, selected questioning techniques for analyzing and conducting discussions with clients in practice will be presented.
