Clash and Convergence: Legal Differences in International Arbitration

HKIAC, 38/F, Two Exchange Square, 8 Connaught Place, Central, Hong Kong
23 Oct, 2026

On Friday, 23 October 2026, from 15:30 – 16:30 our Hong Kong Ambassador Tom Christopher Pröstler brings together perspectives from Switzerland, Hong Kong and beyond for a discussion on how differences between civil and common law traditions play out in international arbitration.

From contract interpretation and good faith to limitation periods, damages, liability exclusions and contractual penalties, differing approaches to substantive law can significantly shape risk allocation, dispute strategy and outcomes. The session will explore what happens when these legal traditions collide and how tribunals, counsel and parties navigate those differences in practice.

The event is currently sold out, but you can still join the waiting list.

Speakers:

  • Lavesh Kirpalani, Barrister & Arbitrator, Prince’s Chambers, Hong Kong
  • Nadine Pfiffner, Independent Arbitrator & Counsel, Zurich
  • Philipp Hanusch, Partner, Baker McKenzie, Hong Kong

  • Tom Christopher Pröstler, Partner, CMS, Berlin & Hong Kong (Moderator)
