Summary: The revision of company law came into force on 1 January 2023, has introduced provisions governing the possibility for the articles of association to provide for an arbitration tribunal for disputes under the company law. It is thus clear that this is legally permissible, even if individual questions still need to be clarified.

But in which cases and for which companies do statutory arbitration clauses fit at all? What are the arguments for and against them? And how should these clauses be used?

These questions first concern lawyers who advise on company law. However, they are dependent on the insights and experience of arbitration practitioners for their advice. We are pleased that we have the honour of Dr.Dieter Granicher as our speaker. Dr. Granicher is a lawyer and notary with Wenger Plattner in Basel, who knows both world very well, through his practice. Among other things he advises companies on corporate law, but also represents them in arbitration courts and acts as an arbitrator and member of the board of directors.
